EB-1 Questionnaire 2 of 2
InfoIf you have won any kind of professional industry awards during your career then we’d love to hear all about it. The type of industry awards are typically not from the company where you have worked such as an employee of the month, or employee of the year, or any kind of recognition from your current employer. We are looking for a competition award, where you have been in competition with your peers from other companies, establishments, or institutions. For those who are in the academic field if you won a major or highlight prestigious grant to continue your research then we’d like to hear all about it. If you do not have this category currently in place but you would like to work on this category, then select “No” here, and a secondary panel will open up and you can choose “Yes” there, and we’ll do all that we can to support you in building evidence for this category. We have excellent resources to help you.
InfoUSCIS will favor awards that were not conferred within the company where you work, as higher recognition is given when you have been conferred an award from a body outside of that of your company. So, if you have not received any award or recognition from outside your own company then enter No here.
InfoHere we are asking if the award was open to nationally, not just in the town or state where you live. The more national in nature award, e.g., open to leaders from all over the country, then better.
InfoThe most prestigious awards are those where the competition is global. Winning an international award can qualify you for an green on its own. For example, if you won a Gold Medal at the Olympics or other international and highly regard event in any field, this would be good to know.
InfoA research grant can be considered as an award. Often times grants: gifts of large sums of money to pursue an area of research are highly sought after and thus there can be intense competition for them. So, if you have won such an answer, we should know about it.
InfoWe will, when we are preparing your case, need to know if you have any proof of having won any kind of award. Such proof could include a photograph of you receiving the award, a certificate of the award, a news clipping of you having won the award, even a letter from the award issuing body congratulating you for having won the award.
InfoIf winning the award generated any trade press whatsoever, then this would certainly add weight as to the importance of you having won this award. Not everyone will have this, but if you do its certainly an advantage.
InfoIf you have won any other awards, please do not hesitate to click ‘Yes’ here and continue.
InfoIf have been nominated for any major award this is important too. Although the EB-1 does not have a ‘Nomination category’ we still want to hear all about it because this means you have been recognized and celebrated for being amongst the very best in your field. Often times, many people, especially in the arts, once they have been nominated for a major award, forever thereafter they will be referred as an “Oscar Nominated……., Tony Nominated…, GRAMMY Nominated person. So, that they will always be recognized as being amongst the very best in their field for that year, and we can use that in the narrative of your case. If you do not have this category currently in place but you would like to work on this category, then select “No” here, and a secondary panel will open up and you can choose “Yes” there, and we’ll do all that we can to support you in building evidence for this category. We have excellent resources to help you.
InfoThe professional awards we are looking to learn more about are any industry awards you have won or indeed, been nominated during your career. These will not be “Employee of the Month” type awards. Typically, these awards are conferred from outside you’re your company by some Industry body where you might have been in competition against other leaders in your field.
InfoThe most prestigious awards are those where the competition is global. Being Nominated for a major award will go a very long way in getting you qualified for an EB-1 green card. For example, if you made the finals at the Olympics or other international and highly regard event in any field, this would be good to know.
InfoIf being nominated for the award generated any trade press whatsoever, then this would certainly add weight as to the importance of this award. Not everyone will have this, but if you do its certainly an advantage.
InfoFor many professions, there will professional organizations where you can apply to become a member. Many of these organizations will have memberships at various levels from student membership all the way up to Fellowship level membership. What we are looking for is that you obtained the highest level of professional membership. If you do not have this category currently in place but you would like to work on this category, then select “No” here, and a secondary panel will open up and you can choose “Yes” there, and we’ll do all that we can to support you in building evidence for this category. We have excellent resources to help you.
Info
InfoHaving articles written about you is very important because if magazines are writing about you then, in theory, you must be important in your field. Quality journals and industry magazines would have no reputation at all if they published interviews and profiles of people who have not achieved that much. So, if they choose to publish an article about you, then you must have a high standing in your field. Truth is, it’s all about perception. Some people have achieved a great deal in their careers but have not sought publicity to make their achievements well known, but they could if they wanted to. If you have been interviewed in a major journal or magazine then you can check “Yes” to this question. If you do not have this category currently in place but you would like to work on this category, then select “No” here, and a secondary panel will open up and you can choose “Yes” there, and we’ll do all that we can to support you in building evidence for this category. We have excellent resources to help you.
InfoIn order for this article about you work as an EB-1 qualifying category, we are looking for a significant amount of the article to be about you and your work. Very often, these articles take the form of a questionnaire and answer format, but not always. The article could also cover your thoughts about general developments in your field work by your peers.
InfoThere are two key areas where you can serve as a judge. Firstly, you can serve as an academic peer-reviewer. Many universities, before they will publish any research work, will have independent peer-reviewers go over the work to make sure everything checks out. The very last thing an academic institution would like to find themselves doing is publish any work that could later be discredited as being false. So, being a peer-reviewer is very important work. The second area is to serve as a judge on an awards like, the Stevie Awards, WEBBYs, CODiE, Globee, Golden Bridge awards, etc. Events like these, and many others will allow you, if you are approved as a judge, to judge review work of the competitors through an online portal and your profile will be featured on their website as one of the judges. If you do not have this category currently in place but you would like to work on this category, then select “No” here, and a secondary panel will open up and you can choose “Yes” there, and we’ll do all that we can to support you in building evidence for this category. We have excellent resources to help you.
InfoThere are many opportunities where you can serve as a judge on a panel of some kind, so if you served as a judge at as live event, then simply enter yes here.
InfoA lot of judging now takes place on. Here, once accepted as a judge you would be sent various links to profiles and materials that you would be able to judge. The Stevie’s, WEBBYs, Golden Bridge, CODiE’s, and many others are examples where you can judge online.
InfoYou could answer yes here if you served as a manuscript peer-reviewer for an academic institution or on an editorial panel for a publication.
InfoThere are many different types of ways to judge depending on your field. So, if your work is related to the arts in some way then you would be judging performances live or based on a screen performance. So, if you have done this type of judging please answer “Yes” here.
InfoThis question is very similar to an earlier question but this question specifically asking about any experience you may have had judging academic papers for an institution. If this is applicable to the work, you have done then you can answer “Yes” here.
InfoMany of the above judging opportunities will publish your name and profile online as one of the judges so as to give the audience an insight as to the caliber of the judges. However, this is not always the case, in other instances, the profile of the judges may be published in a publication. Whilst having such evidence is not essential, it’s definitely helpful in building out the evidence for this category.
InfoEven if there is no mention of you, as a judge, the event itself may have garnered a lot of press and where this is the case, having such information would be very helpful to your case. Again, not essential but certainly helpful.
InfoHere we are looking to see if during the course of your career, you have been involved in the development of any major advancement in the field of which you work. Often times this impact a company significantly by giving them a new product to market, or it can impact the market as a whole causing others to follow. Sometimes, but not always your work had to be patented, and if so, this would go a long way to proving the originality of your work. Patents are not essential but can be helpful in building out your case. So, if you think you might qualify, please check “Yes” hear and then work your question through the questions.
InfoDuring your career to date have you developed any highly significant new or innovative products or processes that have not only had a significant impact within your company, but also had an outsized impact within the industry? Moreover, was this new process or product successfully brought to market.
InfoSometimes, but not always, it is important to file a patent to protect the company from others merely copying the process or product. Some companies will not file a patent because in doing so the details of the process or product must be revealed in order to establish its originality. Some companies like Pepsi Cola, Coke, KFC, will not patent their secret recopies for precisely this reason. So, it’s not a requirement that clients who want to claim that their work is original have to file a patent, but it is really helpful to USCIS if it can process or product can be patented or is currently patent pending. Patent pending simply means that a patent application has been filed but not ruled upon yet. What we are looking to confirm here is that if a patent was filed is your name one of the names cited in the patent?
InfoIt will be really important to demonstrate how successful this innovation was in the marketplace at large. If the significant impact was more internal to the company; for example, saved the company a lot of money, then this can also be taken in order consideration as we build out this category.
InfoMany, but not all new innovations will garner a lot of press. For example, if a new App, product or service is released to a lot of fanfare then this would be a great way to illustrate to USCIS the profile of your work. This is great evidence if we can get it, but it’s not essential that we have it as this sort of fanfare is not appropriate in all cases.
InfoThey say imitation is the best form of flattery. So, if your innovation has been so impactful that the competition is now imitating your product or service, and this can be proven, then such evidence would be very useful in building out this category.
InfoOver the years you may have work in any number of companies where you can point to or innovations or products you have developed that have gone on to become very successful indeed, if this is the case we’d love to hear about it.
InfoThis is one of our most popular categories. Many of our clients do not go out of their way to get themselves published in professional journals. In fact, they have done exceptionally well in their careers without ever finding the that they needed to do this. However, being published can really make you stand out from a crowd and is a really great way to position yourself as a leader in your field. If you have been published, then please click “yes” and work through the inquiry questions. If you do not have this category currently in place but you would like to work on this category, then select “No” here, and a secondary panel will open up and you can choose “Yes” there, and we’ll do all that we can to support you in building evidence for this category. We have excellent resources to help you.
InfoPlease let us know if the article is available online as this will be very helpful indeed.
InfoUSCIS does not mind if you were the sole author for this article or joint, but it is good for us to know.
InfoIt is very common with regards to academic research papers for there to be multiple authors collectively credited for writing the published work. If you are named as one of them this is totally acceptable for USCIS adjudication.
InfoIdeally, it is always good to have more than one example of your scholarly works just in case the officer has a problem with one of them, having two articles will give us some margin.
InfoThis category is primarily for those who work in the visual arts, so if you have had work exhibited or you have performed in front of a live audience or on the big screen, then this category might be for you.
InfoThe more prestigious an event is the more likely that there will be online and even print press coverage. So, if there is such material available covering your event then please select the “Yes” option.
InfoIn addition to online and print press coverage, there might be flyers, ads, and posters regarding the event. Again, if you have such material then please select the “Yes” option.
InfoIf your work has been exhibited and showcased in more than one location and/or at more than one event then this will certainly enhance our ability to build out this category for your case.
InfoHere, USCIS is looking to see if you a working in a leading or critical position for a major company. A leading position relates to you holding a position of leadership in you company doing very important work that has impacted the entire company in a significant way. A Critical role would relate to where you might work in a leadership position or even individually, in a critical area of the company, for example, cyber security, data migration, Health and Safety. Any area that could be considered critical to the company’s well-being.
InfoAn agree is any qualification higher than a bachelor’s degree.
InfoMany senior positions can be evidenced by a showing that the person leads an elite team of professionals. E.g., Software Architect who leads a team of developers. It is highly subjective as to how many people need to be in a team to determine if it’s a large team or team. I would surmise that if you a lead of more than five people, that could be construed as being a large team, but it not definitive. We’ll consider this in the totality of the all the answers as we get to know you.
InfoIn order to satisfy this category your work must have an impact on the company as a whole, and not one department. There are many ways a role can impact a company as a whole. For example, Cyber Security will impact an entire company, Health and Safety can also similarly impact an entire company, and revenue generation be it sales, or cost savings, etc.
InfoHere, think about how your work and or the work of your team impact critical areas of the company. I mentioned a number of areas above such as cyber security, health and safety, sales and costs savings, just to name a few.
InfoIf your company has branching is multiple countries then it is a multinational company.
InfoIf your company only has a branch in one country currently, then it is a national company.
InfoIf other the years you have served in more than one Leading and or Critical role, answer “Yes” here and complete another round of questions.
InfoIn essence, if you earn above the 90 th percentile; in the top 10% for your field, you will automatically qualify for this category, and most of our clients do. Complete this section and we will be able to determine this for you in our evaluation. Note: You should include all annual bonuses as reflected on your past earnings. If you currently work in the U.S. then you would just cite your gross earnings on your for W-2.
InfoThe higher one gets paid the more likely that their compensation package will be a mixture of a base salary, and other emoluments such as Stock Options.
InfoIf you receive any kind of annual bonus performance related or otherwise, please enter yes here.
InfoIf you receive sales based commissions answer yes here.
InfoThis category is reserved for those is have enjoyed commercial success in the arts. Perhaps they starred in a movie that went on you become a block buster hit; meaning it made a lot of money. As long as the genre was related to the performing arts or the arts in general, then we can use this category to great effect.
InfoFor this category USCIS will be looking to see if the event was highly lucrative. Lucrative is a relevant term as a block buster music will make way more money than a Broadway play, or classical concert. So, if we are claiming that the event was commercial successful it will be judged or compared with other similar events where data might be available.
Infothe more prestigious the event, the more likely there will be a lot of press or online coverage of the event.
InfoIf you have been involved in another commercially successful artistic event then please enter “Yes” here and then tell us all about it.
